FTC Funeral Rule Staff Permits Discounted Services Fee for Certain Arrangements

The Federal Trade Commission staff has given the funeral services industry an advisory opinion that many view as an early Christmas present. Funeral Rule Opinion 2009-6 permits the charging of a reduced non-declinable professional services fee on four types of arrangements: 1.) forwarding remains, 2.) shipping remains, 3.) direct cremation, and 4.) immediate burial. This issue has been unsettled for a number of years but now the FTC staff has provided guidance. According to staff, reading the Funeral Rule to prohibit a reduced basic services fee for the four areas mentioned above "would be inconsistent with a core purpose of the Rule, which is to enable consumers to purchase only the funeral goods and services they want by requiring funeral providers to 'unbundle' their offerings." Staff stated that the reduced services fee reflects "the proportionate reduction in facilities overhead and services of the funeral director and staff required to provide them." An analysis of this advisory opinion will be published in the January 2010 issue of ICCFA Magazine. ICCFA Joins Health Care Reform Coalition

The ICCFA has joined the Start Over! Coalition to urge members of Congress to "start over" in drafting health care reform legislation. In conjunction with "Employers for a Healthy Economy," the coalition is made up of over 180 leading employer trade associations representing hundreds of thousands of businesses of all sizes from the 50 states and nearly every sector of the economy. The goals of the coalition are to fundamentally change the health care system to improve care and lower costs without shifting those expenses to the private sector.

As the U.S. Senate begins debate of the Patient Protection and Affordable Care Act, the coalition has identified "swing vote" senators in ten states: Alaska (Mark Begich), Arkansas (Blanche Lincoln and David Pryor), Colorado (Michael Bennett), Connecticut (Joe Lieberman), Indiana (Evan Bayh), Louisiana (Mary Landrieu), Maine (Susan Collins and Olympia Snowe), Nebraska (Ben Nelson), North Dakota (Kent Conrad), and Virginia (Mark Warner and Jim Webb). ICCFA members living in any of these states are urged to email or telephone their senators immediately to ask them to vote "NO" on the pending bill because: 1.) it will not reduce the cost of health care; 2.) would impose a government-run health care plan; 3.) impose employer mandates; 4.) and impose millions of dollars in tax increases and Medicare cuts. Beware: H1N1 Flu Shot E-mail Scam

Government officials are warning the public to beware of an e-mail scam whereby personal information is requested in order for the recipient to obtain the H1N1 flu shot. The e-mail claims to be from the Centers for Disease Control (CDC) and announces the launching of a "State Vaccination H1N1 Program." The scam e-mail states: "You need to create your personal H1N1 (swine flu) Vaccination Profile on the cdc.gov Web site. The Vaccination is not obligatory, but every person that has reached the age of 18 has to have his personal Vaccination Profile on the cdc.gov site." Do NOT click on the link provided in the e-mail to create the so-called "Profile!"

Defending Your Use of Independent Contractors

Many companies use independent contractors to slash payroll taxes and the high cost of fringe benefits. But using outside workers can result in other problems. It's no secret that Uncle Sam wages battle with businesses over freelancers. And the situation is getting worse. The following tips from McLean, Koehler, Sparks and Hammond can help.

In recent years, many workers have turned to a career of consulting. The IRS is on the lookout for companies that use these consultants improperly—especially those that lay off workers and then hire them back as independent contractors to cut labor costs.

Tactics like that don't go over well at the tax agency, so it published guidelines on how auditors should analyze consultants and independent contractors. Often, an audit of the worker means the companies that hire them are also scrutinized by the IRS. To check on what IRS has to say, go to http://www.irs.gov/newsroom/article/0,,id=173423,00.html.

If your independent contractors are legitimately independent, there's no problem. But if they're employees in disguise, the IRS can "reclassify" them as employees and you're slapped with hefty bills for back taxes, plus interest and penalties. And audits by state agencies are also common and frequently occur when freelancers apply for unemployment compensation.

Your company's pension plan isn't immune either. As independent contractors, workers are generally excluded from retirement plan contributions. If the IRS reclassifies them, your company may be penalized and your qualified plan might be disqualified.

To stay on the safe side, consult your tax adviser and make sure freelancers sign contracts that specify:

  • They are not employees for federal income tax purposes and are responsible for paying their own Social Security and Medicare taxes.
  • They are not entitled to employee benefits and are not covered by workers' compensation.

Have your regular employees sign contracts, too. By varying the two types of documents, you can make the case that both categories of employees perform different tasks.
Here are four more tips to safeguard your company:

  1. Consistently treat all workers performing similar tasks as either independent contractors or employees. If contractors must wear ID badges or use company vehicles make sure their contracts explain why. For example, the policy was instituted after customers expressed safety concerns about deliveries in unmarked cars.
  2. Give outside workers considerable discretion about how and when they perform their duties. In general, independent contractors must control the way they get the job done.
  3. Send each contractor a Form 1099 showing non-employee income if you pay $600 or more in a calendar year.
  4. Don't supply freelancers with services you give employees. Some companies have run into trouble with the IRS for providing contractors with office space, computers, cars and other perks. Independents generally furnish their own tools and materials.

So what if you do rehire some laid-off employees as independent contractors? It's difficult—but still possible—to classify them as contractors. But don't let freelancers work in your office and give them new titles. For example, your retained employees might be staff representatives while your new workers are outside service agents.

There's nothing illegal about rehiring former workers as freelancers. You just have to make sure you structure the deals properly so you don't have the IRS breathing down your neck. Reminder: Columbia University Seeks Pandemic Survey Data from ICCFA Members

Earlier this year, the ICCFA was contacted by researchers at Columbia University's Mailman School of Public Health concerning a proposed survey of death care professionals to assess their preparedness in the event of a high fatality pandemic event. A high fatality pandemic will place enormous burdens on the death care and funeral service profession as a whole, although the ability and intentions of individuals within our sector are largely unknown. Selected ICCFA members participated in testing an initial draft survey during the summer and provided recommendations for revisions.

Researchers from Columbia University have finalized the areas of inquiry and are now conducting a large, national, web-based survey to assess the pandemic preparedness of the sector. 2009 KIP Award Deadline Less Than Two Weeks Away

FTC Delays "Red Flags" Rule until June 1, 2010; Sample Program Available from ICCFA

At the request of Members of Congress, the Federal Trade Commission announced that it is delaying enforcement of the "Red Flags" Rule until June 1, 2010, for financial institutions and creditors subject to enforcement by the FTC.

The Rule was promulgated under the Fair and Accurate Credit Transactions Act, in which Congress directed the Commission and other agencies to develop regulations requiring "creditors" and "financial institutions" to address the risk of identity theft. The resulting Red Flags Rule requires all such entities that have "covered accounts" to develop and implement written identity theft prevention programs to help identify, detect, and respond to patterns, practices, or specific activities—known as "red flags"—that could indicate identity theft.

Generally, if a business only accepts credit cards as payment for goods and services, they are not covered under the Rule. However, if a business helps customers fill out credit applications or accepts multiple installment payments (more than two), they may come under the Red Flags Rule.

The Commission previously delayed the enforcement of the Rule for entities under its jurisdiction until November 1, 2009. The Commission staff has continued to provide guidance to entities within its jurisdiction through materials posted on the dedicated Red Flags Rule Web site, www.ftc.gov/redflagsrule. The ICCFA also provides, without charge, its sample Red Flags compliance program to members in good standing. In Observance of Veterans Day: New Bills to Restore Plot/Marker Allowances to Private Cemeteries

eye on congressIn October, the ICCFA Capitol Hill Team met with Rep. Shelley Berkley (D-NV) to discuss the reintroduction of legislation to restore the VA plot allowance eligibility to veterans buried in private and religious cemeteries, and also to restore the marker allowance in lieu of the government-provided grave marker. The Congresswoman introduced H.R. 4044 last Friday, which provides that veterans of any war would be eligible to receive the plot allowance, and also receive the marker cash allowance that was discontinued in 1990. A second bill by Rep. Berkley, H.R. 4045, would increase the amount of the plot allowance from $300 to $745, and increase the burial and funeral expense allowance from $300 to $1,270, and from $2,000 to $4,100.

This proposed legislation was first introduced by Rep. Berkley at the request of the ICCFA in 2007 during the previous Congress. A total of seven House members eventually co-sponsored that bill (H.R. 1273). The ICCFA testified in favor of the original bill and the various veterans organization endorsed the legislation. Today, the new bills already have over 34 co-sponsors. ICCFA members are encouraged to contact their Congressional representatives to urge support for both H.R. 4044 and H.R. 4045.

2010 Music Licenses Now Available: Just $248 Per Property

The ICCFA is offering 2010 music licensing with ASCAP, BMI and SESAC for only $248 per property. With no additional fees or membership requirements, this is the LOWEST PRICE available in the industry!

Companies that currently hold their licenses through the ICCFA have been invoiced.

All companies that did not have a music license in 2009 and wish to purchase the 2010 license can do so by downloading the form or by calling the ICCFA at 1.800.645.7700.

The 2010 price represents no increase from the 2009 rate and is a direct pass-through of the combined annual price increases from ASCAP, BMI and SESAC. Licensing directly with the agencies this year would cost nearly $600 per location.

Music licensing is the law, and failure to obtain a license where one is required can be costly: Copyright law provides for damages similar to fines of up to $30,000 for each song that is infringed. If your company, regardless of size, hosts performances of copyrighted music—whether the music is performed live or played from recordings—music copyright owners say you are legally required to pay an annual licensing fee.

ICCFA Announces Position on H.R. 3655, The Bereaved Consumers Bill of Rights Act of 2009

eye on congressThe ICCFA has formally adopted a position concerning H.R. 3655, a bill introduced by Rep. Bobby Rush (D-IL) on September 25 to require certain disclosures and related matters to all sellers of funeral goods or funeral services. The proposed legislation resulted from an investigation during the summer at Burr Oak Cemetery in Alsip, Illinois, in which cemetery employees allegedly disinterred gravesites without authorization, removed the remains and resold the spaces. (See the Sept. 29 edition of ICCFA Wireless for more details).

The ICCFA met with staff of Rep. Rush, the House Energy and Commerce Committee, the Senate Special Committee on Aging, and the Federal Trade Commission to discuss the proposed legislation. After a careful review by the ICCFA Government and Legal Affairs Committee, the Association has formally adopted the following position:

"1.) that the ICCFA supports the concepts contained in H.R. 3655 as good business practices reflecting the principles in the ICCFA Model Guidelines that were published over a decade ago;

"2.) that the ICCFA recommends amendments to H.R. 3655, specifically:
a.) to make illegal disinterments a federal crime punishable as a felony;
b.) to preempt any state laws that prohibit retailers from selling funeral goods;

"3.) that the ICCFA has reservations over whether the penalties for violations of H.R. 3655 are excessive and outweigh the harm done by such violations;

"4.) that the ICCFA questions the constitutionality of H.R. 3655 by subjecting all religious cemeteries to its requirements.

"It is understood that the ICCFA reserves the right to alter its position on H.R. 3655 due to any amendments or other changes in the proposed legislation."

WARNING: IRS Will Never Contact You by E-Mail

The firm of McLean Koehler Sparks and Hammond has issued the following advisory:

Recently, there has been an upswing in "phishing" type e-mails that appear to be sent from the Internal Revenue Service. The e-mail may reference an underpayment of taxes, tax fraud or a refund due to the taxpayer. The language varies from email to email, but they consistently include an attachment and/or a request that the recipient click on a hyperlink that will take you to a Web site where you can resolve the matter. In an effort to make the e-mail appear authentic, the fraudsters have begun including the official U.S. seal of the IRS in the e-mail.

Just When You Thought It Was Safe: Union "Card Check" Bill Alive and Well

Although the health care reform legislation has taken most of the spotlight in recent Congressional news, businesses should know that the union "card check" bill, the so-called "Employee Free Choice Act," is being actively pursued behind the scenes by its proponents. The legislation, H.R. 1409 and companion bill S. 560, is the subject of compromise discussions led by Sen. Arlen Specter (D-PA). The bill is considered likely to pass easily in the House, so the focus of concern for the legislation has been in the Senate where the mandatory 60 votes are still elusive. Inventive strategies to overcome this deficiency have extended to trying to claim the bill is a "funding" bill, hence requiring only 51 votes under Senate rules. The most controversial provisions in the legislation, the elimination of employees' secret ballot and the mandatory arbitration of a first contract, are the focus of current compromise discussions.

2010 Music Licenses Now Available: Just $248 Per Property

The ICCFA is offering 2010 music licensing with ASCAP, BMI and SESAC for only $248 per property. With no additional fees or membership requirements, this is the LOWEST PRICE available in the industry!

Companies that currently hold their licenses through the ICCFA have been invoiced.

All companies that did not have a music license in 2009 and wish to purchase the 2010 license can do so by downloading the form or by calling the ICCFA at 1.800.645.7700.

The 2010 price represents no increase from the 2009 rate and is a direct pass-through of the combined annual price increases from ASCAP, BMI and SESAC. Licensing directly with the agencies this year would cost nearly $600 per location.

Music licensing is the law, and failure to obtain a license where one is required can be costly: Copyright law provides for damages similar to fines of up to $30,000 for each song that is infringed. If your company, regardless of size, hosts performances of copyrighted music—whether the music is performed live or played from recordings—music copyright owners say you are legally required to pay an annual licensing fee.

eye on congressLast week, the ICCFA Capitol Hill teamed returned to our Nation's Capital for the third year with a record number of appointments to meet with key members of the U.S. House of Representatives and the Senate. The meetings were held in conjunction with the ICCFA Fall Management Conference and appointments on Capitol Hill continued through the entire week. Two issues dominated all the meetings: the recently introduced H.R. 3655 to regulate all funeral sellers (see the previous issue of ICCFA Wireless for details on the proposed legislation), and reintroducing our bill to restore veterans plot and marker allowances as burial benefits. This bill is expected to be introduced on or about Veterans Day by Rep. Shelley Berkley (D-NV).

The hectic pace of hearings and floor votes required the ICCFA team members to meet with legislators wherever possible and included locations ranging from the Senate Gallery to cloak rooms behind hearings chambers. Among the key legislators, ICCFA members met with Sens. John Barrasso (R-WY), Bill Nelson (D-FL), Roland Burris (D-IL), and Reps. Jane Harman (D-CA), Kenny Marchant (R-TX), Joe Crowley (D-NY), John Shaddeg (R-AZ), Joe Barton (D-TX), John Hall (D-NY), Dana Rohrabacher (R-CA), Charlie Dent (R-PA), Ron Klein (D-FL), Kevin McCarthy (R-CA), Shelley Berkley (D-NV), among many others.

Thanks to the ICCFA Political Action Committee (PAC), the association has increased its presence on Capitol Hill in recent years, coinciding with a time in which the funeral and cemetery industry is coming under increased federal scrutiny. Since the issues that generate Congressional interest are usually bipartisan in nature, the ICCFA has reached out to Democrats and Republicans alike. Reminder: ICCFA U.S. Supreme Court Brief Available

On September 24, the ICCFA filed an Amicus Curiae or "friend of the court" brief with the U.S. Supreme Court in the case of Brown v. Hovatter. This litigation seeks to have the Maryland State Morticians' Act declared unconstitutional because it prohibits corporations from owning funeral homes. The Institute for Justice represented the plaintiffs, individuals who are seeking ownership of Maryland funeral homes through the corporate structure, which is routine in about 48 states. The ICCFA had filed an Amicus brief two years ago with the lower U.S. District Court and the court referred to portions of the association's brief in determining that the state law did violate the dormant Commerce Clause of the Constitution by adversely affecting the flow of interstate commerce.

However, on appeal, the U.S. Court for the Fourth Circuit reversed the district court in March of this year by holding that funeral homes provide basically local services and neither those services nor the state law prohibiting corporate ownership affect interstate commerce and, therefore, do not violate the Commerce Clause.

The ICCFA is concerned that the holding of the Fourth Circuit is so seriously flawed as applied to the issues in Brown, that it could be applied to federal law that relies on the existence of interstate commerce to have jurisdiction over funeral homes. In particular, the Court's ruling could render the FTC Funeral Rule unenforceable in the states making up the Fourth Circuit (Maryland, North Carolina, South Carolina, Virginia, and West Virginia). The ICCFA explained to the Supreme Court that although Congress "has long recognized its right under the Commerce Clause to regulate the funeral industry" through a variety of statutes and regulations, following the Fourth Circuit's flawed analysis, the areas of funeral services regulated by the Funeral Rule "could be interpreted as local and not interstate in nature." The ICCFA respectfully urged the Supreme Court to review and reverse the Brown decision.

As a practical matter, the Supreme Court accepts only about five percent of the cases submitted to it under these circumstances (technically called a petition for a writ of certiorari). The ICCFA in adhering to its mission to promote consumer choices, prearrangement, and open competition finds itself in the unique position of defending the constitutionality of the Funeral Rule. 2010 Music Licenses Now Available: Just $248 Per Property

The ICCFA is offering 2010 music licensing with ASCAP, BMI and SESAC for only $248 per property. With no additional fees or membership requirements, this is the LOWEST PRICE available in the industry!

Companies that currently hold their licenses through the ICCFA have been invoiced.

All companies that did not have a music license in 2009 and wish to purchase the 2010 license can do so by downloading the form or by calling the ICCFA at 1.800.645.7700.

The 2010 price represents no increase from the 2009 rate and is a direct pass-through of the combined annual price increases from ASCAP, BMI and SESAC. Licensing directly with the agencies this year would cost nearly $600 per location.

Music licensing is the law, and failure to obtain a license where one is required can be costly: Copyright law provides for damages similar to fines of up to $30,000 for each song that is infringed. If your company, regardless of size, hosts performances of copyrighted music—whether the music is performed live or played from recordings—music copyright owners say you are legally required to pay an annual licensing fee.

Proposed Congressional Legislation Directs FTC to Develop Additional Regulations for Funeral Homes, and Cemeteries, Crematories, Monument Builders, and Third Party Retailers

eye on congressLast Friday, Rep. Bobby Rush (D-IL) introduced H.R. 3655 into the U.S. House Representatives. (See the September 15, 2009 edition of ICCFA Wireless for background information.) The bill contains findings that due to "shocking consumer abuses in the funeral industry" and state laws that "are inconsistent and frequently too weak to provide adequate consumer protections... a need for minimum federal standards" has been created. The bill directs the Federal Trade Commission to "prescribe rules prohibiting unfair or deceptive acts or practices in the provision of funeral goods or services."

A number of the provisions echo the existing FTC Funeral Rule such as furnishing a general price list and prohibiting misrepresentations of federal, state and local law. However, the bill also directs the FTC to develop new provisions absent from the Funeral Rule such as preneed contract disclosures involving future costs, and penalties for cancellation, among other things. These requirements apply to funeral homes, cemeteries, crematories and all retailers of funeral goods or funeral services.

Cemeteries would be specifically required to maintain records including maps and other systems of grave location and the date of each interment. All cemeteries are covered under the bill including all nonprofit, religious, and municipal cemeteries. The only cemeteries exempted are those with fewer than 25 lot sales or interments during any calendar year. The bill has been referred to the House Energy and Commerce Committee, of which Rep. Rush is chairman of the Subcommittee on Commerce, Trade and Consumer Protection.

Members of the ICCFA Government and Legal Affairs Committee met with Congressional staff and were provided with a confidential draft of H.R. 3655 prior to its introduction. The ICCFA made a number of constructive comments on the bill. Presumably, a hearing on the legislation will be held in the near future. The ICCFA is reviewing the bill in order to develop a position either to support or oppose it.

Earlier this year, two national funeral trade associations, Selected Independent Funeral Homes and the National Funeral Directors Association, urged the FTC to expand the Funeral Rule to cover cemeteries and other sellers, but presumably without creating any additional requirements for funeral homes. U.S. Supreme Court: ICCFA Files "Friend of Court" Brief to Support Maryland Litigation; Defends Constitutionality of FTC Funeral Rule

Last week, the ICCFA filed an Amicus Curiae or "friend of the court" brief with the U.S. Supreme Court in the case of Brown v. Hovatter. This litigation seeks to have the Maryland State Morticians' Act declared unconstitutional because it prohibits corporations from owning funeral homes. The Institute for Justice represented the plaintiffs, individuals who are seeking ownership of Maryland funeral homes through the corporate structure, which is routine in about 48 states. The ICCFA had filed an Amicus brief two years ago with the lower U.S. District Court and the court referred to portions of the association's brief in determining that the state law did violate the dormant Commerce Clause of the Constitution by adversely affecting the flow of interstate commerce.

However, on appeal, the U.S. Court for the Fourth Circuit reversed the district court in March of this year by holding that funeral homes provide basically local services and neither those services nor the state law prohibiting corporate ownership affect interstate commerce and, therefore, do not violate the Commerce Clause.

The ICCFA is concerned that the holding of the Fourth Circuit is so seriously flawed as applied to the issues in Brown, that it could be applied to federal law that relies on the existence of interstate commerce to have jurisdiction over funeral homes. In particular, the Court's ruling could render the FTC Funeral Rule unenforceable in the states making up the Fourth Circuit (Maryland, North Carolina, South Carolina, Virginia, and West Virginia). The ICCFA explained to the Supreme Court that although Congress "has long recognized its right under the Commerce Clause to regulate the funeral industry" through a variety of statutes and regulations, following the Fourth Circuit's flawed analysis, the areas of funeral services regulated by the Funeral Rule "could be interpreted as local and not interstate in nature." The ICCFA respectfully urged the Supreme Court to review and reverse the Brown decision.

As a practical matter, the Supreme Court accepts only about five percent of the cases submitted to it under these circumstances (technically called a petition for a writ of certiorari). The ICCFA in adhering to its mission to promote consumer choices, prearrangement, and open competition finds itself in the unique position of defending the constitutionality of the Funeral Rule. 2010 Music Licenses Now Available: Just $248 Per Property

The ICCFA is offering 2010 music licensing with ASCAP, BMI and SESAC for only $248 per property. With no additional fees or membership requirements, this is the LOWEST PRICE available in the industry!

Companies that currently hold their licenses through the ICCFA have been invoiced.

All companies that did not have a music license in 2009 and wish to purchase the 2010 license can do so by downloading the form or by calling the ICCFA at 1.800.645.7700.

The 2010 price represents no increase from the 2009 rate and is a direct pass-through of the combined annual price increases from ASCAP, BMI and SESAC. Licensing directly with the agencies this year would cost nearly $600 per location.

Music licensing is the law, and failure to obtain a license where one is required can be costly: Copyright law provides for damages similar to fines of up to $30,000 for each song that is infringed. If your company, regardless of size, hosts performances of copyrighted music—whether the music is performed live or played from recordings—music copyright owners say you are legally required to pay an annual licensing fee.

ICCFA Meets With Staffs From House Energy and Commerce, Senate Aging Committee, and FTC

eye on congressLast week, members of the ICCFA Government and Legal Affairs Committee met with staffers from the House Energy and Commerce Committee, the Senate Special Committee on Aging, and with Federal Trade Commission staff. The subject of all three meetings focused on the illegal disinterments at Burr Oak Cemetery in Alsip, Illinois, and related issues (see the September 1, 2009 edition of ICCFA Wireless for more information on Burr Oak).

Rep. Bobby Rush (D-IL) chairs the Commerce and Energy Subcommittee on Consumer Protection and represents the district in Illinois where Burr Oak Cemetery is located. The Congressman is interested in introducing federal legislation to address cemetery misconduct as well as recordkeeping requirements, mandatory consumer disclosures and standards for preneed sales. The ICCFA meeting with committee staff reviewed these issues and the Association offered to be an information resource. We will provide more details as progress on the draft legislation develops in the future weeks.

Tips on Negotiating With Bankers to Increase Your Company's Cash

Is your company in the market for a loan? Keep in mind that many bankers are willing to negotiate some of the terms of their loans in order to get your business. The following tips from McLean, Koehler, Sparks and Hammond can help.

You might be able to swing a deal that's more advantageous to your company's cash flow. It has to do with the "compensating deposit balance" required on certain loans.

Bankers often require that you keep some fixed dollar amount or percentage of the face value of a loan in a deposit account. This helps the bank offset some of the risk. But the compensating deposit balance can be calculated in a couple of different ways. The exact calculations can have a big impact on your available cash. Even if a bank's written policy states that the balances are figured using a certain method, you can ask to have the terms changed in your favor. Of course, the higher amount that your company agrees to hold as a compensating balance actually raises the amount of interest you earn. However, your company loses the all-important use of the cash.

Let's say your banker offers you a loan that calls for a $5,000 "daily balance" requirement. That means that before the close of each business day, you must have at least $5,000 in your account. In some cases, bankers "hold" your funds so that they cannot be used accidentally. Here's an alternative strategy: Ask the banker to use an "average" compensating balance calculation instead. Under this calculation, your company doesn't have to scramble to meet the daily balance requirement.

You simply need to keep an average amount in the account during an agreed-upon period, which is usually monthly. This method is better if your company's cash flow fluctuates. Reason: The flexibility of an average compensating balance softens the effect of days when your cash demand is high but deposits aren't flowing in as expected. All of your operating funds are available when you need them most.

ICCFA Offers Sample Influenza Policy for Employee Handbooks

The Centers for Disease Control and various government agencies are urging employers to take preventative measures in case the H1N1 "swine" flu hits badly this Fall. As reported in earlier editions of ICCFA Wireless, businesses should use the guidance and materials provided at http://www.cdc.gov/h1n1flu/business/guidance/.

In addition, ICCFA Labor Law Counsel Michael Pepperman has provided members with a sample workplace policy for dealing with an influenza pandemic. The sample document should be tailored for the specific circumstances of the business and can be posted, sent as a communication to all employees or added to the employee policy manual. Last Chance: Call For Candidates For ICCFA Board of Directors

Serving on the ICCFA Board of Directors offers members a chance to learn about and participate in the leadership of the association, and is a meaningful way to give back to the organization and to the cemetery and funeral service profession as a whole.

The ICCFA's Nominating and Elections Committee is currently inviting members to apply to run for the ICCFA Board of Directors.

The committee will narrow all applications received to 12 nominees, which will be reviewed and approved by the board at the ICCFA Fall Management Conference in Washington, DC, October 7-10. Information on the 12 candidates will then be distributed to the membership, which will vote during the ICCFA Annual Convention & Exposition in San Antonio, Texas, March 10-13, 2010. The top eight vote recipients will serve three-year terms.

To apply, you must be a designated representative of a Regular (Cemetery, Funeral Home or Allied) Member in good standing or you must be an Individual Regular Member in good standing. ICCFA Forms Pet Loss Professionals Alliance

The ICCFA has created the Pet Loss Professionals Alliance (PLPA) to serve the needs of those who provide pet-related death care services. The PLPA will hold its first educational conference and general membership meeting in conjunction with the ICCFA Annual Convention and Exposition, March 10-13, 2010, in San Antonio, Texas.

"There is a real need for leadership and professional development in the pet loss industry," said PLPA chairman Coleen Ellis, president of Two Hearts Pet Loss Center in Greenwood, Indiana. "The ICCFA has long been recognized as the most open and future-focused association on the human side of the industry, and PLPA has found a natural launching point here for developing educational programming and operational standards on the pet side."

Pet loss industry members are invited to review and comment on a proposed mission statement, educational program and draft of operational standards at the PLPA Web site, www.myplpa.com.

Inaugural PLPA Conference
The PLPA Conference will take place March 10-13 at the San Antonio Convention Center in San Antonio, Texas. In addition to the ICCFA Convention general sessions and Expo, pet loss providers will have access to a number of activities developed specifically for them.

Ron Salvatore of Matthews Cremation has been named a coach at the ICCFA Cremation Coaching Center. Salvatore has worked at Matthews for more than 20 years. ICCFA Submits Testimony on Burr Oak Cemetery to House Energy and Commerce Committee

Following up from the August 4, 2009 edition of ICCFA Wireless, the ICCFA has submitted comments to Rep. Bobby Rush, chair of the House Subcommittee on Commerce, Energy and Consumer Protection concerning Burr Oak Cemetery in Alsip, Illinois. The cemetery made national news in July when it was revealed that as many as 300 gravesites where illegally disinterred, the remains dumped or placed in a mass grave, and the spaces resold. Four cemetery employees were charged. Rep. Rush has called for the introduction of federal legislation into Congress to regulate cemeteries, protect gravesites and give peace of mind to the families who have loved ones buried.

The ICCFA has been in discussions with Energy and Commerce staff and submitted comments following the Subcommittee hearing in Chicago on July 27. The ICCFA stated, "To place the Burr Oak atrocity into perspective, references have been made to other cases of the desecration of graves elsewhere in the United States. However, we believe that the Burr Oak case is singular and unique... Previous cases of illegal disinterments involved third parties breaking into a cemetery and rifling graves... Where cemetery personnel have been involved, burial spaces were opened in the belief they were empty. The misconduct occurred when personnel discovered the previous burial or an encroachment on the burial space by an adjacent gravesite, and sought to 'correct' the situation through unethical and illegal means. The Burr Oak allegations indicate that the accused deliberately opened graves they knew contained human remains, removed the remains and discarded them in order to resell the spaces. We repeat that this heinous misconduct is unprecedented to the best of our knowledge."

The ICCFA also pointed out that "there is no federal law that specifically governs cemetery operations. However, cemeteries must comply with literally dozens of federal statutes and regulations that affect their operations from the Departments of Labor, Treasury, Justice, Veterans Affairs, the Environmental Protection Agency, the Equal Employment Opportunity Commission, the Federal Communications Commission, the Federal Trade Commission, even the Federal Reserve Board. In particular, it is important to note that Section 5 of the FTC Act gives the Commission regulatory authority over businesses engaging in unfair or deceptive practices, which includes cemeteries... We respectfully suggest that federal regulations already address most aspects of cemetery operations including sales and marketing practices."

By way of recommendations, the ICCFA noted that "federal law at 18 U.S.C. Sec. 1369 currently makes the willful injury or destruction or attempts to injure or destroy any veterans' memorial on public property, i.e., a national cemetery, a federal crime punishable by fine or imprisonment of not more than 10 years, or both. The ICCFA recommends that this statute be amended to include veterans' memorials on private property, and all cemetery memorials and monuments whether commemorating veterans or non-veterans. Also, the ICCFA asks the Subcommittee to give serious consideration to making unauthorized disinterments in any cemetery punishable as a federal crime." Coming Soon to a Town Near You—the H1N1 Swine Flu

Federal health agencies have rarely been as certain as they are now that the H1N1 "Swine" influenza will be taking a greater toll throughout the United States this fall. The President's Council of Advisors on Science and Technology has stated that as a "plausible scenario," and not a prediction, the H1N1 flu could cause approximately 1.8 million hospital admissions and between 30,000 and 90,000 deaths in the U.S. Seasonal flu typically causes 30,000 to 40,000 deaths, mainly in people over 65. Those at greatest risk of contracting the H1N1 flu are younger people.

In addition to the "regular" flu shot, a special vaccination designed to combat the H1N1 strain is expected to be available by mid-October. If quantities of the vaccine are not sufficient, it may be necessary to establish a priority of who gets the shot first. In descending order: pregnant women are listed first, followed by caregivers to children less than 6 months old, health care and emergency medical services personnel, all people age 6 months to 18 years, then those 18 to 24, then people 25 to 65 who have medical conditions that make them at higher risk for complications from the flu.

ICCFA Members Invited to Join HSIN—Homeland Security Information Network

In partnership with representatives from across the Healthcare and Public Health Sector, the Healthcare Sector Coordinating Council (HSCC) and the Department of Health and Human Services invites ICCFA members to join the Homeland Security Information Network (HSIN) Health and Public Health (HPH) Sector web portal. The HSIN-HPH web portal is designed specifically for those responsible for collecting, analyzing, and using information for the protection of our nation's healthcare and public health infrastructure. HSIN-HPH was developed to give the government and private sector a tool that enables the timely exchange of information for preparing for and responding to disease outbreaks, natural disasters, terrorist attacks, and other all-hazards events. The content of the site includes:

  • Incident information—continuous updates during all-hazards events
  • Alerts, warnings and notifications of credible threats
  • Effective practices and protective measures for sector organizations
  • Policy analysis and research reports
  • Access to other subject matter experts

The HSIN-HPH web portal fully supports government and industry partners in two-way information sharing. The web portal has been organized to display steady-state information as well as the latest updates on current incidents. A separate Incident section can follow several all-hazards events at one time with continuous updates. HSIN has been designed to facilitate information exchange before, during and after an all-hazards event.

How to Register for HSIN-HPH Access

  • Step 1: Go to: https://connect.hsin.gov/hph/event/registration.html.
  • Step 2: Complete all required fields. Note: Be sure to retain your password as it will be required to access the Web site initially.
  • Step 3: Press "Submit" once form is completed.
  • Step 4: Upon submitting the form, an e-mail receipt will be sent to the e-mail address provided which will contain information on the timeframe for application processing and contact information for further assistance. Currently, a response will be received in about seven days.

IRS Seeks Comments on Form 1041-QFT

The Internal Revenue Service announced last week that it is seeking public comments on whether any changes should be made to Form 1041-QFT. This form is used when a trustee of a qualified funeral trust elects to report and pay the tax on trust earnings. The IRS uses the information on the form to determine that the trustee filed the proper return and paid the correct tax. No changes to the form are being made by IRS at this time but the agency has established a public comment period through October 19, 2009 to consider any proposed changes.

According to IRS, approximately 15,000 entities file the Form 1041 QFT and the estimated time to complete the form per respondent is "18 hrs., 1 min." For more information, please contact ICCFA general counsel Bob Fells at rfells@iccfa.com or call 1-800-645-7700.

Call For Candidates For ICCFA Board of Directors

Serving on the ICCFA Board of Directors offers members a chance to learn about and participate in the leadership of the association, and is a meaningful way to give back to the organization and to the cemetery and funeral service profession as a whole.

The ICCFA's Nominating and Elections Committee is currently inviting members to apply to run for the ICCFA Board of Directors.

The committee will narrow all applications received to 12 nominees, which will be reviewed and approved by the board at the ICCFA Fall Management Conference in Washington, DC, October 7-10. Information on the 12 candidates will then be distributed to the membership, which will vote during the ICCFA Annual Convention & Exposition in San Antonio, Texas, March 10-13, 2010. The top eight vote recipients will serve three-year terms.

To apply, you must be a designated representative of a Regular (Cemetery, Funeral Home or Allied) Member in good standing or you must be an Individual Regular Member in good standing. Health Care Reform: Finding the Right Prescription

eye on congressLike clean air, everybody is in favor of health care reform. There is wide agreement that health coverage should not be tied to one's job so if the job is lost, so is the health coverage (or expensively extended through COBRA). Premiums have become more expensive for employers and employees alike, and the one resource for the uninsured, the emergency room, is an untenable provider that shifts its cost on to those who are insured. Why do health policies vary from state to state? Why do some states mandate what insurers must cover and what policyholders must pay for? Why are pre-existing conditions not covered immediately or sometimes not at all?

There are currently five bills for health care reform in play in Congress, plus several policy positions or principles. Perhaps the shortest of these is President Obama's Principles for Health Reform, which by their very nature, are concepts with few specifics. The proposed legislation receiving the most media attention is the 1,000+ page House bill, H.R. 3200, the product of three committees and titled, "America's Affordable Health Choices Act of 2009." All the proposals seek to move the country towards universal health care coverage and all substantially increase the role of the federal government in implementing any of the plans.

Generally speaking, the major proposals would mandate that all individuals must purchase health insurance or pay a penalty to the government. The policies purchased must be those approved by the government. Employers would be required to provide health insurance to employees, even part-timers, or pay a penalty to the government. The government would supplement the premiums that some individuals pay on a scale depending upon how near to the poverty level they are.

Small employers could qualify for premium subsidies through a tax credit. Who qualifies for these subsidies will be determined by the government. These threshold concerns do not even address the major issues of what's covered, what doctors will be available, how soon the doctors can be seen, and who will pay for it. The public health option is increasingly disfavored in polling data and, as widely reported, some town hall meetings with members of Congress have turned nasty.

Just finding accurate and impartial information on the various proposals has been challenging but at least one organization, the Kaiser Family Foundation, has made available a side-by-side comparison of all the plans currently in play in an apparently unbiased manner. We strongly encourage ICCFA members to visit the Kaiser Web site to review this document. It can be accessed at http://www.kff.org/healthreform/upload/healthreform_sbs_full.pdf.

Defenders of the various proposals say that critics only criticize and offer no solutions of their own. This is not accurate and recently the economist Arthur B. Laffer has developed a health care website to document his research and discuss his proposals for reform. In a Wall Street Journal article, Laffer stated, "The proposals currently on offer fail to address the fundamental driver of health care costs: the health care wedge... an economic term that reflects the difference between what health care costs the specific provider and what the patient actually pays. When health care is subsidized, no one should be surprised that people demand more of it and that the costs to produce it increase."

Concerning how to pay for health care reform, Laffer says, "The Obama team has come to the conclusion that we should tax small businesses, large employers and the rich. That won't work because the health care recipients will lose their jobs as businesses can no longer afford their employees and the wealthy flee." According to Laffer, the current proposals will only increase the health care wedge, further separating patients from their doctors as the government becomes the payer.

Instead, Laffer advocates a patient-centered health care reform "with individual ownership of insurance policies and leverages of Health Savings Account, a low premium, high deductible alternative to traditional insurance that includes a tax-advantaged savings account. It allows people to purchase insurance across state lines and reduces the number of mandated benefits insurers are required to cover. It reallocates the majority of Medicaid spending into a simple voucher for low-income individuals to purchase their own insurance. And it reduces the cost of medical procedures by reforming tort liability laws." For more information on Laffer's research, his Web site can be accessed at www.lafferhealthcarereport.org.

FTC Offers Guidance: Paying the Debts of a Deceased Relative

The Federal Trade Commission recently published information concerning who is responsible for paying the debts of a deceased relative. Generally, the decedent's estate is responsible to the extent that there exist sufficient funds. Where there is a shortfall in the estate, the debts usually are unpaid. Except for spouses, relatives typically do not have a legal obligation to pay a deceased relative's debts. However, even a spouse may be limited under some state probate laws. Call For Candidates For ICCFA Board of Directors

Serving on the ICCFA Board of Directors offers members a chance to learn about and participate in the leadership of the association, and is a meaningful way to give back to the organization and to the cemetery and funeral service profession as a whole.

The ICCFA's Nominating and Elections Committee is currently inviting members to apply to run for the ICCFA Board of Directors.

The committee will narrow all applications received to 12 nominees, which will be reviewed and approved by the board at the ICCFA Fall Management Conference in Washington, DC, October 7-10. Information on the 12 candidates will then be distributed to the membership, which will vote during the ICCFA Annual Convention & Exposition in San Antonio, Texas, March 10-13, 2010. The top eight vote recipients will serve three-year terms.

To apply, you must be a designated representative of a Regular (Cemetery, Funeral Home or Allied) Member in good standing or you must be an Individual Regular Member in good standing. Take an Exclusive Behind-the-Scenes Tour of Arlington National Cemetery at the Fall Management Conference

The 2009 Fall Management Conference, October 7-10 in Washington, DC, will feature a behind-the-scenes tour of Arlington National Cemetery and a luncheon at the Women In Military Service For America Memorial, made possible by Matthews International. The ICCFA will lay a wreath at the Tomb of the Unknown Soldier before the tour.

Arlington National Cemetery is the best known of the more than 100 national cemeteries in the United States. Its 624 acres shelter the remains of more than 320,000 servicemen and women, veterans from every war and major conflict in United States history. This is our nation's most sacred military shrine and bears silent witness to the whole of American history. More than four million people visit the cemetery annually, many coming to pay final respects at graveside services, of which nearly 100 are conducted each week.

The cemetery is the final resting place of many presidents, Supreme Court justices, military generals and national heroes. Its seemingly endless rows of memorials to the nation's war dead are punctuated by well-known monuments such as John F. Kennedy's Eternal Flame memorial and the Civil War Unknowns monument.

The cemetery recently completed a half-mile new stone wall that includes 6,573 niches on the inside. The Millennium Project, which will develop new gravesites and columbarium courts on the western edge of the cemetery, completed its first phase of construction in January 2009. Phase II will be underway at the time of our tour.

Horse-Drawn Hearse For Sale
We are offering our original horse-drawn hearse that was used in the owner's funeral home in Blytheville, Arkansas by the present owner's grandfather.
