ALERT: U.S. Postal Service to Increase Rates on May 11; First Class Stamp Will Cost 44 Cents, Other Rates Affected

The U.S. Postal Service has announced that, effective May 11, the price for a 1-ounce First-Class Mail stamp will increase from 42 to 44 cents. Prices for other mailing services—Standard Mail, Periodicals, Package Services (including Parcel Post), and Extra Services—will also change. ICCFA members using direct mail marketing should check now to determine whether the postal increase will affect their costs.

House Bill Would Allow Private Sector Employees to Give Comp Time in Lieu of Overtime Pay

eye on congressLast week, H.R. 933, The Family-Friendly Workplace Act, was introduced by Rep. Cathy McMorris Rodgers (R-WA) to amend the Fair Labor Standards Act of 1938 (FLSA) by permitting private sector employers to provide compensatory time off in lieu of overtime pay. Currently, only public employers (the government) may use comp time instead of paying overtime wages. H.R. 933 has 13 co-sponsors to date.

In her remarks introducing the bill, Rep. McMorris Rodgers stated that "a study by the Employment Family Foundation found that a significant majority, 75 percent, of workers prefer time off instead of overtime pay, and more than eight in 10 women, 81 percent, prefer to have that benefit as well ... To be clear, the Family-Friendly Workplace Act would not change the employer's obligation under FLSA to pay overtime at the rate of one-and-a-half times an employee's regular rate of pay for any hours worked over 40 in a seven day period. The bill would simply allow overtime compensation to be given—at the employee's request—as paid time off, at the rate of one-and-a-half hours of comp time for each hour of overtime worked, provided the employee and the employer agree on that form of overtime protection. The bill contains numerous protections to ensure that the choice and use of comp time is a decision made by the employee."

What are the chances of H.R. 933 moving forward? All the co-sponsors of the bill are Republicans, and given the significant Democratic majorities in both the House and the Senate, this bill will require bipartisan support. Historically, unions have been hostile to the use of comp time in lieu of overtime pay, which further complicates this bill's chances for passage. The legislation has been referred to the House Committee on Education and Labor. The ICCFA will track this bill and report developments to our members.

Elder Abuse Victims Act is Passed by U.S. House of Representatives

eye on congressLast Wednesday, the House of Representatives passed H.R. 448, the Elder Abuse Victims Act of 2009, by a vote of 397-25. This legislation has been pending for several years and has generally been supported by the ICCFA. The legislation would establish various elder abuse prosecution and research programs, as well as advocacy grant programs.
Initial drafts of the legislation specifically referred to funeral directors among care providers who could receive training to recognize signs of elder abuse and neglect. The current legislation no longer specifies funeral directors but refers to medical examiners and coroners among those who could receive training.

The bill also requires the Department of Justice, in consultation with the Department of Health and Human Services, to submit a report to Congress (including the Senate Special Committee on Aging) concerning an examination of state laws relating to elder abuse, neglect and exploitation, and laws relating to fraud through mail, telemarketing, or the Internet, among many other provisions. This bill was apparently passed by the House prior to any cost estimate being submitted by the Congressional Budget Office although the language authorizes appropriations of $3 million for the fiscal years 2009 through 2015 for advocacy grants. The bill will now be referred to the Senate for further consideration.

ICCFA University Program Now Online!
Scholarship Deadlines Right Around the Corner; ICCFAYOU Newsletter Requests Your Feedback

The ICCFA University, July 17-22 at the Mid-South Convention Center in Tunica, Mississippi, offers five days of intensive educational programming in six colleges:

  • College of 21st Century Services
  • College of Administration and Management
  • College of Cremation Services
  • College of Funeral Home Management
  • College of Land Management & Grounds Operations
  • College of Sales & Marketing

Among the highlights of this year's program, students who complete the College of 21st Century Services will become certified celebrants and will receive intensive celebrant training from the In-Sight Institute, as well as education on providing exceptional services from renowned educator Alan Wolfelt, Ph.D. Also, students who complete the College of Cremation Services will receive three types of certification: as cremation operators, administrators and arrangers.

HURRY—ICCFAU Scholarship Deadlines Right Around the Corner!
The ICCFA Educational Foundation will award its second annual scholarship to the 2009 ICCFA University. The scholarship can be used to pay the registration fee, lodging and travel expenses related to attending the University program. The Foundation is a tax-exempt 501(c)(3) charity that supports the association's educational programs. Applicants for the scholarship must be ICCFA members in good standing and employed in the cemetery, cremation and funeral profession for a minimum of two years. Deadline for submission: February 28, 2009.

Recently, the Central States Cemetery Association made an endowment to the ICCFA Educational Foundation to establish an annual scholarship award to the ICCFA University. Details of the endowment will be forthcoming, but applications for the new scholarship are being accepted through March 15. To be eligible, applicants must work in one of the central states of Arkansas, Illinois, Iowa, Kansas, Missouri, Oklahoma or Wisconsin, and be employed by a cemetery for a minimum of two years. Applicants must be able to attend the 2009 ICCFA University, held July17-22, and may not assign the scholarship award to another person. All decisions of the Central States Cemetery Association Scholarship Committee and the ICCFA Educational Foundation are final. 2008 KIP Award Winners Announced

Created by the ICCFA Personalization Committee, the KIP (Keeping It Personal) Awards program honors recipients in four categories: Best Practices/Personal Touch; Innovative Personalized Product (Supplier); Most Personalized Service or Memorial; and Events.

This year's contest drew 22 entries from across the United States and abroad. Communications and marketing professionals from outside the cemetery and funeral service profession performed the judging. Information on all the winners is available on the ICCFA Web site. Applications for the 2009 KIP Awards will be available from the ICCFA in April. The ICCFA congratulates the winners and all who entered the 2008 KIP Awards!

In a joint program with the Erie County Veterans Services Department and the County Burial Division, Mount Calvary Cemetery Group's Pine Lawn Cemetery created a program in which honorably discharged veterans who are cremated and cannot afford a proper burial may be buried for free. Mount Calvary staff assists in securing the veteran's granite military marker and arranges for a military forces honor guard and a celebrant if needed.

McKenzie & Blundy Funeral Home & Cremation Centre

Sarnia, Ontario, Canada
McKenzie & Blundy partners with the St. Clair Region Conservation Authority to plant a tree in memory of each deceased customer. Each family receives a sympathy card informing them a tree has been planted, a commemorative tree notice with the obituary of their loved one, a brochure about the McKenzie & Blundy Memorial Forests, an invitation to the annual dedication ceremony and a letter of gratitude for supporting reforestation. In addition, plaques bearing the customers' names are placed on a memorial wall at the funeral home.

Olinger Mt. Lindo Cemetery

Morrison, Colorado
Olinger Mt. Lindo Cemetery hosts as an annual 5K race, the Hike for Hospice. Now in its 12th year, the purpose of the event is to raise funds and increase awareness of hospice. The hike begins at Olinger Mt. Lindo Cremation Nature Garden & Mausoleum. Olinger employees assist rest stops, provide a personalized dove release in memory of a loved one and provide goodie bags at the finish line. This year's event had 350 participants and raised more than $10,000 to benefit two hospices.

Speaks Family Legacy Chapels

Independence, Missouri
Speaks Family Legacy Chapels' hosted its Third Annual "Lest They Be Forgotten" Veterans Program at the Harry S. Truman Presidential Library. During the event, a packed auditorium gathered to watch the premiere of "Korea, The Forgotten War," by documentary filmmaker Larry Cappetto. Cappetto had spent two days capturing on film the personal stories of families left behind by fallen veterans. David Speaks served as chairman of the event. The colors were posted by the local American Legion post, and following the film, an American flag that had flown over the U.S. Capitol was presented to a survivor of the only Congressional Medal of Honor recipient from Independence, Missouri. A panel discussion followed. Speaks also sponsored a two-month local public television film series titled "Lest They Be Forgotten."

Known as "the life of the party," David Byerly wanted to go out in style. Olinger Highland Mortuary & Cemetery helped his family arrange a service that included music from Phantom of the Opera, Kid Rock and Motley Crue, along with cigars, Denver Broncos paraphernalia, huge floral displays, skiing and golf equipment and guitars. Byerly's final resting place is a handpainted martini glass that serves as an urn.

Busch Funeral & Crematory Services

Cleveland, Ohio
Capt. Michael Medders was killed while serving in the U.S. Army in Iraq. The funeral home arranged for video footage to be taken of the processional route to and from the airport and through the town where his father was chief of police. Local news covered the events. The two-hour funeral mass was broadcast via the Internet to Capt. Medders' fellow troops in Iraq and at the Army base where he was stationed in Fort Hood, Texas. More than 3,000 attended his visitation at a local high school while more than 1,500 attended his mass. Over 80 agencies, organizations and communities assisted the funeral home in their efforts.

Miller-Jones Mortuary and Menifee Valley Memorial Park

Hemet, California
Veronica Calderon was a member of an equestrian group and an avid horse rider. Following a chapel memorial service, her equestrian troupe presented a "Spanish Walk" march in parade formation, carrying flags and accompanied by a "banda" style brass band and an elaborately dressed vocalist. Charro attire was worn by performers. Her horse performed a "piaffe" dance to say goodbye. Family and friends returned to the reception house and memorial park to enjoy traditional Spanish foods.

Music Licensing
The 2009 Music Licenses are available for just $248 per property, no additional fees. Covers ASCAP, BMI and SESAC. Any U.S. funeral home, cemetery or related business is eligible for membership as a Music License Member. Licensing directly with the agencies this year would cost nearly $600 per location, so this price—which requires no additional membership fee—is still the lowest available to the industry.

Tax-Related Questions

Fraud Prevention & Detection Consultation Service
ICCFA has retained the services of veteran fraud investigator Robert A. Garvey Jr., CPA, CFE, CrFA, CVA, to serve as a consultative resource for members' employee theft and fraud concerns. The new member benefit, the "Fraud Investigation and Deterrence Consultation Service" or FIDCS, will allow members to discuss by telephone any issues or concerns related to suspected fraudulent activity or a desire to put systems and controls in place at their locations to deter such activity. Legal Advice on Cremation Concerns
Courtesy of the ICCFA Government and Legal Fund, ICCFA members now have access to pre-paid legal advice on cremation-related issues. Through this exclusive member benefit, the association has retained Poul H. Lemasters, Esq., of Rosenacker & Associates, Ltd., Cincinnati, Ohio. Poul is an attorney and licensed funeral director, and members in good standing may call him at 1.800.221.2889 to discuss cremation concerns for up to 20 minutes at no charge.

FTC 'Red Flag' Compliance Program
