CALL TO ACTION: H.R. 3655, Bereaved Consumers Right Act, is Part of Frantic Efforts as 111th Congress Wraps Up

eye on congressAs Leo Durocher once noted, "It ain't over 'til it's over." He was speaking of baseball but he might as well have been referring to the seemingly endless 111th Congress. Tax legislation aside, there is a grab bag of bills that sponsors are jockeying for a place on the House suspension calendar and H.R. 3655, the Bereaved Consumers Bill of Rights Act, is one of them. Introduced in September 2009 by Rep. Bobby Rush (D-IL), this bill was a reaction to the Burr Oaks Cemetery scandal in Chicago although almost nothing in the bill addresses the issues involved in Burr Oaks.

However, Rep. Rush has been a tenacious champion of his bill, which would require the FTC to establish a "Funeral Rule II" applying to cemeteries, crematories, and all retailers of funeral-related goods or services. The Rush bill is silent on penalties but as an FTC trade regulation, statutory penalties will be assessed at $16,000 per violation. A number of funeral directors trade association have persuaded some of their members that "Funeral Rule II" would not affect them, therefore a number of funeral organizations and individuals are actively lobbying for passage of HR 3655. In fact, a number of new forms of potential liability would be imposed on funeral homes should the Rush bill become law.

As the 111th Congress attempts to wrap up business, whereby all bills not passed by both houses would expire, the ICCFA has learned of efforts to combine HR 3655 with the Senate-passed S. 3860, a bill to regulate Arlington National Cemetery. The Senate bill has been added to the House "suspension calendar" that places it in cue for approval by the House without a formal vote actually being taken. An alternate plan involves placing HR 3655 as a stand-alone bill on the calendar. According to House rules, bills on the calendar cannot be amended nor are they supposed to be controversial. For these reasons, the Rush bill should not be appearing on the House calendar or combined with the Arlington Cemetery bill. Unfortunately, nobody can provide such assurances and proponents of HR 3655 continue lobby to combine the two pieces of proposed legislation.

HOW YOU CAN HELP: All ICCFA members are urged to contact their Representative by phone or email urging 1.) opposition to placing HR 3655 on the House suspension calendar, and 2.) opposition to combining HR 3655 with S. 3860, which has been added to the suspension calendar. The fastest way to convey your concerns is to call the Capitol Hill switchboard at 202-224-3121 and ask to be connected to the office of your Congressman. If you are uncertain who is your Congressman, go online to www.house.gov and type in your zip code. You will instantly be given links to your Congressman via email and phone.

Apply For a Scholarship to Attend ICCFA University 2011

The ICCFA provides a variety of annual scholarships to attend ICCFA University through the ICCFA Educational Foundation, a tax-exempt 501(c)(3) charity that supports the association's educational programs. Applications are now available for the 2011 session of ICCFA University, July 22-27 at the Fogelman Conference Center at the University of Memphis.

NEXT GENERATION SCHOLARSHIPS
The ICCFA Next Generation Committee has created a scholarship fund through the ICCFA Educational Foundation and will be offering three $1,600 scholarships to the 2011 session of ICCFA University. Applicants must be ICCFA members in good standing and employed in the cemetery, cremation and funeral profession for a minimum of two years. Jewish Funeral Directors of America to Meet in Conjunction with ICCFA Annual Convention & Expo

The Jewish Funeral Directors of America Inc. (JFDA) will hold its annual spring meeting in conjunction with the International Cemetery, Cremation and Funeral Association's 2011 Convention & Exposition, March 8-11 at Mandalay Bay in Las Vegas, Nevada.

"We are pleased to invite the JFDA and its membership to join us at our convention," said ICCFA President Kevin Daniels, CCE. "We hope this leads to a lasting relationship and opportunities for future cooperation."

"We are excited to participate in the ICCFA Annual Convention & Exposition in Las Vegas and thank the ICCFA for their hospitality," said JFDA President Albert Bloomfield.

JFDA members will have access to all ICCFA educational sessions and the exhibit hall. In addition, the JFDA has created a one-day program to meet the specific the needs of its members, as follows:

  • Thursday, March 10 (8:30-10 a.m.)—JFDA Meeting of Members.
  • Thursday, March 10 (2-3:30 p.m.)—"Uni-faith Mourning Practices in an Inter-faith World: Issues and Strategies," presented by Rabbi Sanford Akselrad, Congregation Ner Tamid, Henderson, Nevada. Inter-faith marriage has become the "norm" among American Jewry with about 50 percent of marriages resulting in an inter-marriage. This presents profound challenges at a time of grief. How does an inter-faith family mourn? How does a non-Jewish spouse mourn for a Jewish spouse? Beyond burial issues are the issues related to ritual, planning the funeral, and dealing with families of different religious backgrounds and beliefs about the after life. Rabbi Akselrad will present this interactive session, encouraging participants to share their experiences in their roles as Jewish funeral directors.
  • Thursday, March 10 (3:30-5 p.m.)—"The Death of Moses: What It Teaches Us About Death and Dying from the Jewish Perspective," presented by Rabbi Malcolm Cohen, Temple Sinai, Las Vegas, Nevada. The Torah culminates in Moses' death. This episode is wistful but poetic. Participants will learn and discuss some of the Rabbinic legends associated with this incredible event, including how Moses fights the Angel of Death and how God finally takes him to his resting place. The texts deal with end-of-life issues which have practical relevance to funeral directors. This session will give participants the opportunity to clarify their own theological and spiritual responses to death.

CBS '60 Minutes' to Broadcast Story on Funeral Industry Early Next Year

According to staff, the report is being produced over the next few weeks and is expected to air early in 2011, although no date has been set. eye on congressSenate Fails to Repeal Onerous 1099 Reporting Requirement on Small Businesses

Yesterday, the U.S. Senate failed to muster the two-thirds majority needed to repeal the Form 1099 reporting requirement in new healthcare law at Section 9006 (The Patient Protection and Affordability Act). The provision requires businesses to issue a Form 1099 to any person or company that provides $600 or more annually in services or merchandise. This requirement is scheduled to take effect in 2012 and threatens to become a major burden to small businesses. Although Democrats and Republicans seemed agreed on repeal, the discussions broke down over the issue of how to make up the $17 billion shortfall if the provision were repealed. The ICCFA will be working with the Tax Reform Coalition to achieve the eventual repeal of this provision when the new Congress convenes in January.

2010 KIP Award Deadline Extended to December 10

KIPApplications for ICCFA's 2010 Keeping It Personal (KIP) Awards are available for download. The mission of the awards program is to recognize the best in personalization in the cemetery, cremation and funeral service profession. Deadline for submission is December 3.

Created by the ICCFA Personalization Committee, the KIP program honors recipients in five categories:

  • Best Practice/Personal Touch: A "best practice." Something that you do for every family, or every family in a certain situation (examples: when the deceased is a veteran, or a baby). Note: An event such as a Christmas program is NOT a best practice, it's an event.
  • Most Personalized Service or Memorial: An outstanding example of a personalized funeral for a particular individual, or a very personalized memorial. Explain how your staff provided a particular family with a funeral service or memorialization that really told the story of their loved one's life.
  • Events: For the most personal and creative workshop, seminar or holiday event sponsored by your cemetery or funeral home. The even must include the participation of your clients and/or the general public. Such events may include, but aren't limited to, themes that are educational, commemorative, charitable, celebratory, financial or psychological in nature.
  • Innovative Personalized Product (suppliers only): Product that memorializes in a personal and meaningful way. The product may be physical or virtual and may include, but is not limited to, memorials, monuments, urns, art, printed material and Web-based tributes.

U.S. GAO Studies State Funeral and Cemetery Laws

eye on congressThe ICCFA has been contacted by the Government Accounting Office (GAO), which is the investigative arm of Congress, for assistance in surveying the extent of state laws regulating cemeteries, funeral homes, crematories, and related businesses including third party retailers. GAO is drafting a survey that it will send to every state agency having oversight of the death care industry. It is the ICCFA's understanding that the catalyst for the study is not directly related to H.R. 3655, the Bereaved Consumers Bill of Rights Act, which remains pending in the House of Representatives during this "lame duck" session. According to GAO staff, the study has been requested by several members of Congress including Sen. Christopher Dodd (D-CT), who is retiring from Congress at year's end.

GAO staff estimate that the study will be completed and published by late spring or perhaps early summer. From that point, it is unclear what action, if any, Congress will take to implement any findings or recommendations in the GAO report. The ICCFA will continue to work closely with GAO to provide substantial factual data to aid in the report. For example, Rep. Bobby Rush (D-IL), the sponsor of H.R. 3655, repeatedly claimed in public statements that only ten states have cemetery laws. Despite the data sent by the ICCFA to Rep. Rush and his staff documenting that all states have cemetery laws, the Congressman continues to claim that only ten states have such legislation. Therefore, the GAO report can do much to establish the record concerning the true extent of industry regulation by the states.

State Cemetery Regulators File Comments on H.R. 3655, the Bereaved Consumers Act

The North American Death Care Regulators Association (DCRA), an association of primarily state agencies regulating cemeteries, has filed written comments with members of Congress concerning H.R. 3655, the Bereaved Consumers Bill of Right Act. DCRA, through its Executive Committee, stated, "We believe that the regulation of cemeteries and death care should be at the local level. It is our general observation that the vast majority of issues involved with funerals and burials tend to be local in nature. As a result, local regulation will be the most effective and more targeted, to accomplish the intended results. That said, we understand a comparable level of consumer protection doesn't exist in all states."

The DCRA letter notes, "As regulators, we are aware of the scandals and consumer harm at Burr Oak Cemetery...[and elsewhere].... Much of the noted abusive conduct was criminal and it is somewhat unclear how the legislation [H.R. 3655] targets the abusive practices involved in these cases. A federal system of examinations and investigations that would discover such conduct is unlikely.... We also raise a question about the approach used to define a 'cemetery'... it would be impossible to know for certain whether certain cemeteries will be subject to the statutory provisions in any given year.... Finally, a regulatory structure in which certain cemeteries could regularly move in and out of the statutory requirements would seem undesirable."

H.R. 3655 was passed by the House Energy and Commerce Committee in July and is currently pending before the full House. It is uncertain whether the bill will be considered during the "lame duck" session of Congress now underway. If the bill is not passed by both the House and the Senate by the adjournment "sine die" of Congress at year's end, all pending bills expire and must be reintroduced next year or thereafter. What It Means to You: Republicans Gain Control of the House, Increase Numbers in Senate

eye on congressWhile some races are undecided as of this writing, it is clear that the Democrats have retained control of the U.S. Senate although with a smaller majority. This means that the Democrats will continue to chair all Senate committees and, thereby, set the agendas and legislative priorities for that chamber for at least the next two years. Unlike the Senate, where only 38 of the 100 seats were up for election, all 435 seats in the House of Representatives were up for grabs. The Republicans needed to gain 39 seats in the House to become the majority party. The latest count indicates a pickup of 60 seats. This means that all of the chairmanships of the House committees will be changing from Democrats to the Republicans for the next two years, including the position of Speaker of the House currently held by Nancy Pelosi (D-CA).

Of particular interest to cemetery and funeral industry members are the outcomes of three House races where funeral directors were candidates. Incumbent Democrat Charlie Wilson (OH) lost, while Republican challengers Steve Southerland (FL) and Randy Hultgren (IL) won their respective races. Wilson was a two-term Congressman who voted for ObamaCare, the union "card check" legislation, and the cap and trade bill. Wilson was also a co-sponsor of H.R. 3655, the Bereaved Consumers Bill of Rights Act, which remains pending in the House. This legislation was approved by the House Energy and Commerce Committee in July despite the vocal opposition of the ranking minority member Joe Barton (R-TX). Barton is now in line to chair the Energy and Commerce Committee in 2011.

The ICCFA is maintaining a close monitoring of the existing Congress that will reconvene during the week of November 15 for a "lame duck" session. Although many members will not be returning to Congress in January, they are technically still voting members and can approve new legislation during November and December. Tax legislation will be the focus of much attention during the lame duck session, but it is possible for H.R. 3655 to be called up for a vote. Stay tuned.

FTC Goes "Green" With New Regulations on "Green" Products and Services

The Federal Trade Commission (FTC) is accepting comments through December 10, 2010, concerning proposed revisions to its existing Green Guides first issued in 1992. According to FTC, "The proposed changes are designed to update the Guides and make them easier for companies to understand and use. The changes ... include new guidance on marketers' use of product certification and seals of approval, 'renewable energy' claims, 'renewable materials' claims, and carbon offset claims."

The proposed Green Guides "caution marketers not to make blanket, general claims that a product is 'environmentally friendly' or 'eco-friendly' because the FTC's consumer perception study confirms that such claims are likely to suggest that the product has specific and far-reaching environmental benefits. Very few products, if any, have all the attributes consumers seem to perceive from such claims, making these claims nearly impossible to substantiate." The proposed revisions also address claims that a product is degradable or "free of" a particular substance. "For example, if a marketer claims that a product that is thrown in the trash is 'degradable' it should decompose in a 'reasonably short period time'—no more than one year."

It is unclear how the revised Guides will affect providers offering "green funerals" or "green burials." Even claims that cremation is "green" may require specific substantiation under the new Guides. Procedurally, FTC Guides are enforced differently from its trade regulations such as the Funeral Rule. The purpose of the Guides is to caution businesses from engaging in questionable activities that could trigger an enforcement action under the FTC Act for alleged deceptive and misleading sales practices. This means that cemeteries, crematories, and third party sellers of funeral goods or services have always been under the jurisdiction of the FTC, regardless of who or what the Funeral Rule covers. The New Alignment in the 112th Congress and What It Means to You

eye on congressIf the polls and the pundits are even partially correct, there will be a major power shift in the new 112th Congress when it convenes in January. Should the Republicans gain a majority in either the House (likely) or the Senate (unlikely), the chairmanships of all the committees will change from one party to the other. More than just housekeeping, this shift means that legislative priorities will also change. Should the Democrats maintain their majority in the House or Senate, the leadership may choose to change the individual chairs and perhaps elect a new Speaker of the House, currently Rep. Nancy Pelosi (D-CA).

The existing 111th Congress has gained a reputation, whether fairly or unfairly, as being anti-business. For example, one of the new requirements in the so-called ObamaCare health laws is the requirement that businesses must distribute a Form 1099 for every expense of $600 or more. The inability of this Congress (so far) to extend the "Bush Tax Cuts" will result in increased taxes beginning on January 1 if the "lame duck" session of Congress fails to act when it convenes in November and December. Ironically, the Washington, DC area, including southern Maryland and Northern Virginia, has been largely spared the fallout of the recession. Home values have dipped only slightly and employment levels remain good in the area. Federal, state and local governments are major employers in the Washington metro area as well as private contractors working for government agencies. It is interesting to note that during the Great Depression of the 1930s, the government did not count civil service employees in the employment reports. Today, government workers are counted, leading some observers to say that this overstates the employment statistics and that the unemployment rate is worse than the government is reporting.

Congressional Research Service Publishes Summary of Veterans Burial Benefits

The Congressional Research Service (CRS) published an updated summary of veterans burial benefits earlier this month. The document not only updates the various benefits in terms of recent legislation that upgrades some of them, but provides a useful index of key statutes and pending bills that affect burial benefits. "America's Veterinarian" To Share Experiences on
How to Help Families Deaing With Pet Loss

Dr. Marty Becker, known as "America's Veterinarian" for his roles as an on-air consultant with "Good Morning America" and as a columnist for Parade magazine, will examine the human-animal bond and the role of death care professionals in assisting those who have suffered the loss of a pet at the second annual conference of the Pet Loss Professionals Alliance, March 8-11 at Mandalay Bay in Las Vegas, Nevada. The conference is being held in conjunction with the International Cemetery, Cremation and Funeral Association's Annual Convention & Exposition, and Becker will command the Convention's "main stage" in a presentation that will reach the hearts and minds of everyone involved in the death care profession.

In "You Have to Know the Heights of Love to Understand the Depths of Loss," Becker will offer a fascinating exploration of the human-pet connection and its profound effect within the lives of pet owners. Medical doctors, psychologists and veterinarians agree: People don't just want to have pets in our lives, they need pets. Study after study shows that pets have the power to heal; because of this, the loss of a pet can be especially traumatic. The "pet parent" loses a friend and a healer.

Having witnessed thousands of people deal with pet loss, Becker will offer his insights into how death care professionals—both those who work specifically in the area of pet loss and also those who operate traditional cemeteries and funeral homes—can offer a skilled, warm hand to pet owners to validate their loss and gently guide them along the rocky road of grief.

Becker is the resident veterinarian for "Good Morning America" and "The Dr. Oz Show." He is a regular contributor to Parade magazine and is the pet-care expert for the AARP. He has authored and co-authored numerous books, including "Chicken Soup for the Pet Lover's Soul," "The Healing Power of Pets: Harnessing the Amazing Ability of Pets to Make and Keep People Happy and Healthy" and The New York Times best-seller, "Why Do Dogs Drink Out of the Toilet?"

H.R. 3655 Cliffhanger: Bereaved Consumer Rights Bill Pending in Congress Through Year's End

eye on congressAt this writing, both houses of Congress have adjourned until after the November 2 elections. The leadership of both the Senate and the House of Representatives have announced that they will reconvene by November 14 for a "lame duck" session to consider passing new laws, possibly right up to December 31 when, by law, the 111th Congress must permanently adjourn. At that point, all bills not voted on will expire and must be reintroduced into the new 112th Congress to begin the process all over again.

Most attention is understandably focused on whether the Bush Administration tax cuts will be extended or allowed to expire at the end of this year. However, of particular, and perhaps peculiar, concern to the cemetery and funeral industry is H.R. 3655, the Bereaved Consumers Bill of Rights Act, which is pending before the full House for a vote.

H.R. 3655 was passed by a voice vote of the House Energy and Commerce Committee in July. The ICCFA testified in opposition to the bill and has rallied additional opposition from numerous industry trade associations, within and outside of the cemetery and funeral industries.

Two factors currently in play may affect whether or not H.R. 3655 becomes law in the final weeks of 2010. The first issue is the impact of the cost analysis of the bill (reported in the previous edition of ICCFA Wireless). The second factor is a new Senate bill, S. 3860, which seeks to impose new regulations on Arlington National Cemetery. While this bill does not affect private sector cemeteries or related businesses, the provisions of H.R. 3655 could eventually be incorporated into this legislation.

Just prior to the Senate recess at the end of September, Senators Claire McCaskill (D-MO), Scott Brown (R-MA), Joseph Leiberman (I-CT), Susan Collins (R-ME), and Richard Burr (R-NC), introduced S. 3860 to impose strict new regulations on Arlington National Cemetery in the wake of serious mismanagement problems at the cemetery. The bill is focused entirely on Arlington but through the Congressional amendment process, its purposes can be expanded to address other issues involving the private sector.

Depending on the priorities of the House and Senate leadership during the "lame duck" session, H.R. 3655 could be forwarded to the Senate for consideration or S. 3860 could be passed by the Senate and forwarded to the House. In either event, both bills could be combined for a vote, or possibly added to an appropriations bill that Congress will be considering. ICCFA members will be kept informed of significant developments.

FTC Would Need 5 Full-Time Staffers, $1 Million Annually, to Implement H.R. 3655, Bereaved Consumers Act

eye on congressThe Congressional Budget Office (CBO), the non-partisan staff that calculates the funding needs of proposed federal legislation, has published its costs estimates of H.R. 3655, the Bereaved Consumers Bill of Rights Act. "Based on information from the FTC [Federal Trade Commission], CBO assumes that the agency would require five additional staff positions at a cost of about $1 million per year to develop and enforce the new requirements, train staff, and develop additional materials…. Enacting H.R. 3655 could affect revenues from collection of civil penalties; therefore, pay-as-you-go procedures apply." This means that Congress could not simply add another million dollars to the FTC annual budget, but must show where the additional funds are coming from. The two typical sources are by either cutting funds for other programs or by raising taxes. The CBO stated that revenue collected from penalties for violations of H.R. 3655 "would not be significant in any year."

The CBO report also discussed the compliance costs incurred by the private sector: "Most providers and retailers of funeral goods or services are already in compliance with many of the mandates contained in the legislation through compliance with state law or current industry standards. Based on information from industry professionals and on data on the cost of compliance from the FTC, CBO estimates that the additional compliance costs for these mandates would be small relative to the annual threshold for private-sector mandates." It is noteworthy that CBO acknowledges existing compliance with the requirements of H.R. 3655, thus suggesting that the legislation is irrelevant and unnecessary. H.R. 3655 was passed by a voice vote of the House Energy and Commerce Committee on July 21 and is awaiting a full House vote, although to date the bill has not been added to the House schedule. The ICCFA testified in opposition to the bill and has rallied additional opposition from numerous industry trade associations, within and outside of the cemetery and funeral industries. Last week, approximately 400 members of the National Association of Towns and Townships (NATaT) met with their Congressional representatives on Capitol Hill to express their opposition to H.R. 3655. ICCFA General Counsel Robert M. Fells was a speaker at the NATaT Conference last Wednesday in Washington, DC.

Tax Relief Coalition Petitions Congress to Extend All Bush-Era Tax Cuts Expiring December 31

eye on congressThe Bush Administration income tax cuts enacted in 2001 and 2003 are due to automatically expire on December 31, unless Congress passes new legislation to extend these savings into 2011 and beyond. To date, much debate and discussion has occurred but no Congressional action. President Obama has urged Congress to extend the tax cuts, with the exception of "high-income" taxpayers, which he defines as individuals earning more than $200,000 annually or married couples earning more than $250,000.

However, the nonpartisan Tax Foundation has published a report indicating that approximately 39 percent of the tax increase on high-income taxpayers would come from business income. The higher taxes are estimated at $630 billion in revenue, meaning that $246 billion in taxes would come from business income over a ten-year period. About one-third of all business taxes are paid by owners of flow-through businesses such as sole proprietorships, partnerships and S corporations that file individual tax returns.

The ICCFA, through its partnership in the Tax Relief Coalition (TRC), has contacted all members of the House of Representatives to urge legislative action to extend all the 2001 and 2003 tax rate reductions. The TRC represents more than 1,000 trade associations, corporations and advocacy groups numbering over 1.8 million businesses and millions of individuals. According to the TRC, "There is ample evidence that a bipartisan majority of the House would support a clean bill extending all current tax rates to ensure that no American faces a tax increase in this difficult economic environment." IRS Ramps Up Audits for Businesses Using Independent Contractors

eye on congressThe Internal Revenue Service has initiated an employment tax audit program that focuses heavily on worker classification. This program, the Employment Tax National Research Project, will audit 6,000 randomly selected businesses over the next three years by a team of specially trained agents. The IRS has estimated that employers who improperly classify employees as independent contractors cost the federal government as much as $2.72 billion in uncollected taxes.

Businesses often benefit financially by using independent contractors because, unlike employees, the business is not required to: 1.) withhold Medicare and Social Security taxes or pay a matching amount; 2.) withhold the full amount of an employees' federal unemployment tax; or 3.) withhold federal income taxes. The factors to determine whether a worker is properly classified are complicated, although the Revenue Act of 1978 provided "safe harbor" rules to protect businesses that have a history of classifying workers as independent contractors.

The IRS traditionally used a twenty-point "common law" analysis to determine the proper classification of a worker but, by 1987, the agency consolidated this analysis by grouping the factors into three categories. Fortunately, section 530 of the Revenue Act of 1978, mentioned above, provides a simplified method for the IRS to determine whether a business may retain its workers' classification, prior to using the "common law" analysis. Even if erroneously classified as an independent contractor, Section 530 provides that a worker "shall be deemed not to be an employee" of the employer if the employer meets its requirements. If the business meets these requirements, Section 530 will provide relief from employee tax obligations regardless of the actual relationship with the workers as determined under the general tax "common law" analysis. In practice, the common law test will not be used if the 530 requirements are satisfied.

Unfortunately, legislation has been introduced into Congress to sharply curtail and possibly eliminate the Section 530 protections. H.R. 3408, introduced by Rep. Jim McDermott (D-WA) and a companion bill, S. 2882, introduced by Sen. John Kerry (D-MA) have been pending since last year. To date, no action has been taken on either bill. More information on this issue will be forthcoming, including a special article from ICCFA tax counsel Les Schneider's firm that outlines the factors used by the IRS. Stay tuned for more.

IRS Publishes List of Organizations at Risk of Tax-Exemption Revocation

Recent federal legislation requires that all organizations exempt from federal income tax must file an information tax return with the IRS, even those entities with annual income less than $25,000, which previously were not required to file a return. Since the entities that would be affected tend to be small, there is concern that these groups could be unaware of the new filing requirement and, as a result, lose their tax exemption by October 15 if a filing is not made. The IRS has published a list of organizations at risk for revocation, and provides links to additional relevant information at http://www.irs.gov/charities/article/0,,id=225889,00.html.

Call For Candidates For ICCFA Board of Directors: Deadline to Apply Next Wednesday

Serving on the ICCFA Board of Directors offers members a chance to learn about and participate in the leadership of the association, and is a meaningful way to give back to the organization and to the cemetery and funeral service profession as a whole.

The ICCFA Nominating and Elections Committee is currently inviting members to apply to run for the ICCFA Board of Directors.

The committee will narrow all applications received to 12 nominees, which will be reviewed and approved by the board at the ICCFA Fall Management Conference in Scottsdale, Arizona, October 27-30. Information on the 12 candidates will then be distributed to the membership, which will vote during the ICCFA Annual Convention & Exposition in Las Vegas, Nevada, March 8-11, 2011. The top eight vote recipients will serve three-year terms on the Board.

To apply, you must be a designated representative of a Regular (Cemetery, Funeral Home or Allied) Member in good standing or you must be an Individual Regular Member in good standing. First Impression Cremation Phone Shopper Program Launched

The International Cemetery, Cremation and Funeral Association now offers the "First Impression" cremation phone shopper program to help owners and managers determine the type of impression their staff is making when answering a call for cremation information.

"Many people in our industry think of cremation phone shoppers as being primarily price-oriented," said ICCFA Director of Cremation Services Julie A. Burn, CCrE, CSE. "But in reality, many of them are concerned more with value than with cost. A cremation call is an opportunity to provide immediate value by providing exceptional customer service and education. It is an opportunity to capture the fastest growing market in your community."

Through the program, Burn acts as a consumer requesting information on cremation. The results of the telephone conversation are provided along with basic recommendations on how staff can improve their communication skills with the phone shopper. It assists participants in determining:

  • What their staff is communicating to today's cremation consumer
  • Whether their staff is fully promoting the value of their company
  • Whether they would do business with the person representing their company
  • Whether there is a need for a staff phone shopper training program

The cost of the program for ICCFA members is $85 per call for one to five calls and $75 per call for six or more calls. The ICCFA Educational Foundation, a 501(c)(3) charity, is pleased to announce that it has received a contribution from the Western Cemetery Alliance in the amount of $17,435. Call For Candidates For ICCFA Board of Directors

Serving on the ICCFA Board of Directors offers members a chance to learn about and participate in the leadership of the association, and is a meaningful way to give back to the organization and to the cemetery and funeral service profession as a whole.

The ICCFA Nominating and Elections Committee is currently inviting members to apply to run for the ICCFA Board of Directors.

The committee will narrow all applications received to 12 nominees, which will be reviewed and approved by the board at the ICCFA Fall Management Conference in Scottsdale, Arizona, October 27-30. Information on the 12 candidates will then be distributed to the membership, which will vote during the ICCFA Annual Convention & Exposition in Las Vegas, Nevada, March 8-11, 2011. The top eight vote recipients will serve three-year terms on the Board.

To apply, you must be a designated representative of a Regular (Cemetery, Funeral Home or Allied) Member in good standing or you must be an Individual Regular Member in good standing. First Impression Cremation Phone Shopper Program Launched

The International Cemetery, Cremation and Funeral Association now offers the "First Impression" cremation phone shopper program to help owners and managers determine the type of impression their staff is making when answering a call for cremation information.

"Many people in our industry think of cremation phone shoppers as being primarily price-oriented," said ICCFA Director of Cremation Services Julie A. Burn, CCrE, CSE. "But in reality, many of them are concerned more with value than with cost. A cremation call is an opportunity to provide immediate value by providing exceptional customer service and education. It is an opportunity to capture the fastest growing market in your community."

Through the program, Burn acts as a consumer requesting information on cremation. The results of the telephone conversation are provided along with basic recommendations on how staff can improve their communication skills with the phone shopper. It assists participants in determining:

  • What their staff is communicating to today's cremation consumer
  • Whether their staff is fully promoting the value of their company
  • Whether they would do business with the person representing their company
  • Whether there is a need for a staff phone shopper training program

Just When You Thought It Was Safe: House Reconvenes During Summer Recess

eye on congressThis week the U.S. House of Representatives reconvened to pass additional legislation less than two weeks after recessing until September 13. This unusual session was prompted by the need to provide funding to states to avoid layoffs of teachers and other public employees. There is the possibility that the House will consider other bills during this week's session although it is unlikely that H.R. 3655, the Bereaved Consumers Bill of Right Act, would be among them.

More troubling, the Senate has announced its schedule for the remainder of the year and the House is expected to coordinate its own schedule accordingly. Both houses of Congress historically adjourn by October during an election year, occasionally reconvening for a rare "lame duck" session after the elections to pass critical legislation such as departmental budgets. However, this year there is every indication that both houses will continue passing legislation right up through December 31st.

The following is the Senate's announced schedule: upon the completion of work during the week ending August 6, the Senate will adjourn until Monday, September 13. In session: September 13 to October 8. Out: October 11 to November 12. In session: November 15-19. Out: week of November 22 (Thanksgiving week). In session: November 29-__.

So far, no target date for adjournment has been announced. As a practical matter, this schedule suggests that H.R. 3655 could be in play right up to the end of the year, when all bills not passed will automatically expire. If brought up for consideration, many members of Congress voting on the bill will know they are not returning either through retirement or being defeated in their bid for re-election in November. For ICCFA members, this possibility means that we will have to continue to be vigilant against efforts to call up H.R. 3655 for a vote through the end of 2010.

Call For Candidates For ICCFA Board of Directors

Serving on the ICCFA Board of Directors offers members a chance to learn about and participate in the leadership of the association, and is a meaningful way to give back to the organization and to the cemetery and funeral service profession as a whole.

The ICCFA Nominating and Elections Committee is currently inviting members to apply to run for the ICCFA Board of Directors.

The committee will narrow all applications received to 12 nominees, which will be reviewed and approved by the board at the ICCFA Fall Management Conference in Scottsdale, Arizona, October 27-30. Information on the 12 candidates will then be distributed to the membership, which will vote during the ICCFA Annual Convention & Exposition in Las Vegas, Nevada, March 8-11, 2011. The top eight vote recipients will serve three-year terms on the Board.

To apply, you must be a designated representative of a Regular (Cemetery, Funeral Home or Allied) Member in good standing or you must be an Individual Regular Member in good standing. Call For Presentations for ICCFA 2011 Annual Convention—
Deadline August 15

In preparation for the ICCFA 2011 Convention & Exposition, March 8-11 at Mandalay Bay Resort & Casino in Las Vegas, Nevada, Convention Planning Committee Chairman Mike Uselton, CCFE, has issued a call for presentations.

For the past two years, this Convention has helped ICCFA members and attendees Join the Evolution of this rapidly changing industry and has offered them practical advice on how to take The Next Step for themselves and their businesses. This year, we are looking for presentations that will continue to guide them toward "A Bright Future!"

If you have expertise in a particular area of cemetery, cremation and funeral service, this is your opportunity to give back to your profession. Proposals are due to ICCFA by August 15. Guidelines are as follows:

1. Include your name, title, company name, address, phone, fax and e-mail.

2. Include a description of your session (approximately 100 words). Session descriptions should name at least two or three specific skills, techniques or ideas the attendee will take away from the session. We are most interested in sessions that share concrete, proven techniques and programs, as opposed to theory or opinion.

3. Include a brief bio regarding your experience and qualifications within the industry as well as any speaking experience you may have.

4. Include information on which areas of our profession are the intended audience, e.g., cemetery owners and managers, funeral home owners, funeral directors, sales managers, etc.

5. Let us know how long you anticipate your presentation will take. In addition to full-length sessions and workshops, we are interested in shorter presentations that can be combined to form panel sessions.

6. Indicate what types of audio/visual aids you will use, if any.

7. Include a list of anticipated handouts.

8. Note that we ask that speakers refrain from speaking about prices or other issues subject to antitrust legislation. In addition, we ask that speakers refrain from overt promotion of their own products/services.

We typically receive many more proposals than we can fit into the program. The committee has to choose among many excellent proposals, so please be sure to follow these guidelines and to clearly explain the value proposition for attendees (#2 above). He'll share his expertise on how to take a strategic plan from idea to action, including topics such as recognizing necessary change, avoiding poor planning and understanding and communicating strategic goals.

The conference program will be rounded out on the final day with a presentation by employee benefits expert Scott Morsch on how the new health care laws and the choices employers make with regard to those laws will affect their companies, as well as a panel discussion on the government and legal issues facing the profession.

The Pet Loss Professionals Alliance (PLPA) subcommittees have been working for the past six months to create standards of practices and definitions, build alliances with veterinarians and other pet care providers, develop a Certified Pet Loss Provider (CPLP) certification program, promote PLPA membership and plan for its next annual conference, to be held in conjunction with the ICCFA 2011 Convention & Exposition, March 8-10 at Mandalay Bay in Las Vegas.

The committee and its members have begun receiving media attention both among the veterinary and pet owner communities. Coverage of the group's first annual conference was reported in JAVMA News, the newsletter of the American Veterinary Medical Association and in My EVT: Exceptional Veterinary Team. Most recently, Tails Magazine ran an article featuring PLPA Chair Coleen Ellis and member Bill Remkus.
