JUST IN: Congressman Rush Uses Arlington Cemetery Hearing to Push His "Bereaved Consumers Rights Act"
Yesterday, June 30, the House Armed Services Committee convened a hearing to discuss the Arlington National Cemetery investigation and findings of mismanagement. The two scheduled witnesses, Secretary of the Army John McHugh and the Army Inspector General LTG R. Steven Whitcomb, did not address private sector cemeteries nor did they attempt to draw any parallels between government and private sector cemeteries. However, Rep. Bobby Rush (D-IL), sponsor of H.R. 3655, the Bereaved Consumers Bill of Rights Act, obtained Chairman Ike Skelton's consent to question the witnesses. Rush, who is not a member of the Armed Services Committee, attempted to draw a comparison between the operational problems at Arlington and with private sector cemeteries to justify his bill.
Rush stated that H.R. 3655 seeks to establish only minimum "guidelines' for cemetery operations through rulemaking by the Federal Trade Commission. He said that his bill would apply to all cemeteries including Catholic, Jewish, profit and nonprofit. However, he cautioned that "powerful organizations" are attempting to carve themselves out of the bill's coverage. Rush finally asked Army Secretary McHugh his opinion of H.R. 3655, which McHugh declined to answer and noted only that whatever standards the bill mandated, Arlington Cemetery would exceed them in the future.
The Rush bill is pending in the House Energy and Commerce Committee where it was headed for a vote at a May 5 hearing. Bipartisan amendments were introduced to exempt religious cemeteries, which were met by objections from Rep. Rush. He withdrew his bill from the Committee's consideration pending resolution of the exemption issue. His statements today suggest that he is unwilling to exempt any cemeteries from his bill.

PA Funeral Directors Association Settles Defamation Litigation for $825,000
The Pennsylvania Funeral Directors Association (PFDA) has settled a nearly decade-long lawsuit filed against it and its executive director by plaintiffs Robert Rae and his company, Commonwealth Funeral Consultants/Golden Considerations. The complaint was filed in the state court in Pennsylvania and alleged that defendants had "maliciously defamed plaintiffs, stating that plaintiffs' preneed insurance marketing program was illegal, and that plaintiffs were under investigation by the Pennsylvania State Board of Funeral Directors, and asserting that any funeral home doing business with plaintiffs would also be investigated by the Board." Defendants settled the litigation for $825,000 with no admission of liability on their part.
In a separate Pennsylvania lawsuit against the members of the state Funeral board, the PFDA has sought to intervene as another defendant. The plaintiffs in Heffner, et al., v. Murphy, et al., are owners of funeral homes in the state who allege that certain regulations of the Funeral Board are unconstitutional and deprive plaintiffs of their constitutional rights to conduct business. PFDA motioned to the court to intervene to protect its members' interests, but the court denied the motion stating, "The success or failure of the action at bar will neither prevent PFDA's members from continuing to practice funeral directing as they currently do nor legally compel them to engage in conduct they do not wish to take."
The Court sharply commented, "Indeed, it appears that the only legitimate interests articulated by PFDA are the business interests of its members, in that they will experience more vigorous competition in the marketplace if the allegedly unconstitutional regulations are invalidated. However, PFDA's members have no legally cognizable right to the business they fear losing to this increased competition." The court also rejected PFDA's argument "that its interest in the instant litigation is not adequately represented because Defendants have refused to discuss the matter with them.... Bluntly, so what?" At this point in time, the merits of the case must still be adjudicated.

Citrin Cooperman & Company, LLP, an accounting and business consulting firm, will be surveying funeral home owners and directors as part of its annual Funeral Directors Survey, which it has produced for more than a decade.

Fall Management Conference Provides MBA-Level Training Tailored for Death Care Executives
The ICCFA has contracted with instructors from two of the world's top business schools to provide customized research and training at its 2010 Fall Management Conference, October 27-30 at Camelback Inn Resort & Spa in Scottsdale, Arizona.
On the first day of the conference, John Austin, Ph.D., senior consultant in executive development for Decision Strategies International and an instructor for senior executives at the University of Pennsylvania's Wharton School of Business, Georgetown University and Duke Corporate Education, will present a three-hour session on strategic planning. Fraud Prevention & Detection Consultation Service
ICCFA has retained the services of veteran fraud investigator Robert A. Garvey Jr., CPA, CFE, CrFA, CVA, to serve as a consultative resource for members' employee theft and fraud concerns. The new member benefit, the "Fraud Investigation and Deterrence Consultation Service" or FIDCS, will allow members to discuss by telephone any issues or concerns related to suspected fraudulent activity or a desire to put systems and controls in place at their locations to deter such activity.
