FTC Red Flags Rule: Effective June 1

Delayed twice, it appears that the Federal Trade Commission's "Red Flags" Rule will become effective in two weeks on June 1st. The rule requires financial institutions and creditors to implement a written plan to prevent and detect identity theft of their customers' financial information. The definition of "creditor" is very broad and includes many retailers that arrange credit for their customers or have an installment payment plan for services and goods provided. Due to the many different types of arrangements that may trigger compliance, ICCFA members are urged to check the FTC information at http://www.ftc.gov/bcp/edu/microsites/redflagsrule/index.shtml to determine if they may be covered. UPDATE: H.R. 3655, the Bereaved Consumers Bill of Rights Act—Withdrawn but Not Gone

eye on congressFollowing up on the previous edition of ICCFA Wireless, H.R. 3655 was brought before the full House Energy and Commerce Committee on May 6 for a "markup" and expected approval. The next step would have been a floor vote by the full House of Representatives. The markup session proceeded predictably and the bill was within five minutes of being approved along a party line vote (All Democrats in favor, all but one Republican opposed) when a breakdown occurred. Both sides introduced an amendment to exempt religious organizations but the bill's sponsor, Rep. Bobby Rush (D-IL), surprised his fellow Democrats by objecting to the exemption, saying it would "gut the bill." The Committee recessed for five minutes, but never reconvened. It was learned later that Rep. Rush had asked that his bill be withdrawn from consideration for the time being.

WHAT'S NEXT: We expect H.R. 3655 to be rescheduled by the Energy and Commerce Committee pending the resolution of the conflict between Rep. Rush and his colleagues over the religious exemption issue. We expect to receive only 36 hours advance notice for the new markup session - and it may be only a matter of days before it is scheduled and there is some speculation that the bill maybe scheduled prior to the Memorial Day recess. So please stand by and be prepared to take action when you hear from ICCFA.

IN THE MEANTIME: NFDA continues to actively support passage of H.R. 3655, even claiming that the bill has "bipartisan" support, which is incorrect. To set the record straight on what H.R. 3655 would and would not require, please review and the share the following information with your colleagues.

Then please consider the following points that will affect not only ICCFA member funeral homes but all funeral homes:

1.) Does H.R. 3655 impose additional responsibilities on funeral homes beyond the Funeral Rule?

YES. Every funeral director should be aware of these and decide their impact on their own business. It is important to read the bill and draw your own conclusions.

2.) Does H.R. 3655 limit the FTC's new rulemaking to the terms in the bill?

NO. The bill doesn't say, but in fact the Federal Trade Commission is free to expand the mandated rulemaking in any direction it wishes, including increased regulation of funeral homes. AARP and FCA should be expected to urge FTC to be expansive.

3.) Are there new fines or penalties in H.R. 3655 that can affect funeral homes?

YES. The bill doesn't say, but by imposing new disclosure obligations on funeral homes, they run the risk of additional fines for violations that currently do not exist under the Funeral Rule. Recently, the maximum fines were raised from $11,000 to $16,000.

4.) Worst case, can't funeral homes opt for the FROP program to avoid the huge fines?

NOBODY KNOWS. The bill doesn't say, but the FTC has full authority whether it wishes to expand the existing FROP option, leave it as is, or terminate the program.

In sum, the ICCFA expresses its willingness to support H.R. 3655 if it addressed the issues at Burr Oak Cemetery (Illegal disinterment, fraudulent reselling of burial spaces) that prompted the legislation, but has serious concerns that the bill does NOT address these issues. Instead, the legislation would establish a minefield of new violations for relatively minor offenses, punishable by crushing fines on small businesses.

NEW—FTC Staff Opinion Letter: the Funeral Rule Applies in Puerto Rico

The Federal Trade Commission staff has posted a new advisory opinion on the FTC Web site concerning whether the Funeral Rule applies to funeral providers in Puerto Rico. The issue was raised when some legislators in the Commonwealth House of Representatives stated their belief that the Funeral Rule is inapplicable in Puerto Rico. FTC staff confirmed that the Funeral Rule does apply in Puerto Rico citing its authority to prohibit "unfair or deceptive acts or practices in or affecting commerce." The term "commerce" is defined as "commerce among the several states or with foreign nations, or in any territory of the United States..." Since Puerto Rico is a U.S. territory, the Funeral Rule applies to funeral providers located there.
