ICCFA Files Amicus Brief with Federal Court in PA Litigation

Yesterday (August 29), the ICCFA filed an "Amicus Curiae" or Friend of the Court brief in the U.S. District Court for the Middle District of Pennsylvania in the case of Heffner, et al. v. Murphy, et al. The litigation challenges the state funeral law that restricts the ownership of funeral homes and also prohibits crematories from dealing directly with the public. Plaintiffs argue that the statute violates the Commerce Clause, the First Amendment of the U.S. Constitution and the Due Process protections of the U.S. Constitution by requiring that only a Pennsylvania licensed funeral director may own a funeral home or offer cremation services to the public.

The ICCFA brief points out that under the existing law, "a five-year-old grandchild of a Pennsylvania funeral director would qualify to own stock [in a funeral home]… even a spouse who is certified as legally incompetent would qualify to obtain a widow's license and own his or her spouse's funeral home upon the death of that spouse." Regarding the prohibition on crematories communicating directly with the public, the ICCFA brief observed, "The state-endorsed monopoly over cremation granted to Pennsylvania funeral directors is all that more inappropriate because funeral directors do not necessarily possess any expertise in cremation. As the Record amply demonstrates, funeral directors are not trained in the science of cremation and possess no special knowledge therein. "

New Federal Requirement: Employers Must Post Notice That Workers Can Organize a Union and List Unlawful Employer Practices

On August 25, 2011, the National Labor Relations Board (NLRB) issued a final rule entitled "Notification of Employee Rights Under the National Labor Relations Act." The rule will have a significant impact on union-free and partially unionized employers. As published, it requires that all employers covered by the National Labor Relations Act (NLRA) post a notice informing employees of their right to organize and lists a litany of unlawful employer conduct. Failure to post the notice is an unfair labor practice and may be considered as evidence of unlawful motive in certain proceedings before the NLRB. A failure to post may also toll the statute of limitations for unfair labor practices allegedly committed during the period in which an employer fails to post the notice. These penalties, and the prospect of igniting union organizing, may have serious consequences for the unprepared. The requirement to post will become effective on November 14, 2011. Call For Candidates For ICCFA Board of Directors

Serving on the ICCFA Board of Directors offers members a chance to learn about and participate in the leadership of the association, and is a meaningful way to give back to the organization and to the cemetery and funeral service profession as a whole.

The ICCFA Nominating and Elections Committee is currently inviting members to apply to run for the ICCFA Board of Directors.

The committee will narrow all applications received to 12 nominees, which will be reviewed and approved by the board at the ICCFA Fall Management Conference in Naples, Florida, September 21-23. Information on the 12 candidates will then be distributed to the membership, which will vote during the ICCFA Annual Convention & Exposition in Las Vegas, Nevada, March 19-22, 2012. The top eight vote recipients will serve three-year terms on the Board.

To apply, you must be a designated representative of a Regular (Cemetery, Funeral Home or Allied) Member in good standing or you must be an Individual Regular Member in good standing. The ICCFA is offering its one-day Crematory Operator and Arranger Certification programs this fall.

Cremation Operator Certification: October 5 in Fort Worth, TX, held after CPLP Training Program
Wednesday, October 5, from 8 a.m. to 5 p.m. with sign-in and continental breakfast beginning at 7:30 a.m.

Presented by ICCFA cremation coaches Julie Burn, CCrE, CSE; Poul Lemasters, Esq., principal, Lemasters Consulting; and Larry Stuart Jr., general manager, Crematory Manufacturing & Service Inc. The extensive training curriculum includes:
